This Privacy Policy applies to www.hoocht.com and its related mobile applications. This Privacy Policy tells you what to expect when HOOCHT. Ltd collects personal information about you. We will not collect any personal information about you unless it is in response to you using our website or actively applying for one of our online products or services. We value your privacy, and the security of your personal information is extremely important to us.

Any reference to “we” or “us” or “HOOCHT.” in this Privacy Policy shall mean HOOCHT. Ltd. Throughout this Privacy Policy “you” means the customer.

Any reference to “Lender” in this Privacy Policy means a lender offering a mortgage product you apply for through the HOOCHT. service.

Our Privacy Policy is regularly reviewed to make sure that we continue to serve your privacy interests. We reserve the right to update this Privacy Policy, and any changes will be posted on our site or we may email you directly if we deem it necessary.

For the purpose of the Data Protection Act 1998, the registered data controller is HOOCHT. Ltd, whose registered office is at The Deep Business Centre, Tower Street, Hull, HU1 4BG.

What information we collect

When you visit our site, or complete an application with us, we collect the following types of information: name, address, contact details, social media login details (such as Google+ and Facebook), employment details and financial information such as banking details, salary, savings, and financial commitments.

In addition to the above, we collect information from you through communications with us and from outside sources (such as credit bureau for the purposes of identification verification) – we acknowledge that some of this data may be sensitive personal data. We will keep this type of sensitive personal data in an appropriately secure way. We will also collect explicit consent from you to process this type of data.

We also collect information about your computer, including your browser type, your operating system, your device type and your IP address. We collect this information for site optimisation and product/service improvements. For more information on this please refer to our cookies policy.

We may also record calls for training and monitoring purposes.

We may collect geo-location data from you but this will be with your explicit consent and in relation to a specific activity.

How we will use your information

The information we collect will be used for the purpose of brokering a mortgage or any other product/service you have explicitly consented to.

For example, we will:

  • operate, manage and complete any account you hold with us and any mortgage applications you consent to us making;
  • (if you take out a mortgage through us) compare your mortgage product from time to time with others in the market that may be suitable for you and contact you with suggestions if we think it appropriate;
  • carry out market research, business and statistical analysis including the formation of a view on you as an individual in order to service you and others better;
  • test our systems and develop our products (or any other similar purpose);
  • comply with any regulatory obligation we must comply with; and
  • contact you, by any medium you have agreed to or provided us with details of, in relation to our goods and services if you have indicated that you are happy to receive marketing from us.

From time to time we would also like to contact you with details of other services we may provide and with relevant news and comment that may be of interest to you as a mortgage applicant or owner. This could be, by way of example, an email newsletter or other similar communication. You retain the right to opt out at any point should you wish to in the future, and the communications will include instructions on how to do so quickly and easily.

We will hold your personal data on our systems as follows:

  • all data pertaining to a mortgage application will be kept on our systems for 6 years in line with our regulatory requirements.

We may share your information with the following entities:

  • any group company;
  • any regulatory or governmental body or ombudsmen who has jurisdiction;
  • any credit bureau (or similar organisation) (for identification verification purposes only – we do not conduct a credit search and no search footprint is left on your credit file);
  • a lender to which you have consented for us to make a mortgage application on your behalf;
  • suppliers who process your data on our behalf. We will have written contracts in place with such entities which require them to process your data only in accordance with our instructions; and
  • any person or legal entity to whom we sell or transfer (or initiate discussions with to sell or transfer) our business or any part of it or any of our rights or obligations under any agreement we may have with you. If the transfer goes ahead, you agree that the purchaser can use your data in the same way as us.

We may transfer your data to destinations outside the EEA. Any such transfer will be made on terms that ensure that your data is treated securely and in accordance with this privacy policy and the UK Data Protection Act 1998.

Access to your information/how to contact us

Under the Data Protection Act 1998, you have a right to access certain personal records we hold about you. This is called a Data Subject Access Request, which you can make by writing to info@hoocht.com. A £10 fee is payable.

We value any feedback you may have. If you have any, please also email us at the above address.

If you have changed your mind about receiving marketing from us, you can opt out at any time by clicking the unsubscribe button or link at the bottom of any of our marketing emails.

Security

We pride ourselves in treating your data with the utmost care and security. Our systems meet or exceed industry standards and we are constantly monitoring these to provide improvements where available.

We will never store passwords in plain text, nor will we allow anyone to access your data unless they have a justifiable reason to do so. All of our employees are background checked before they are granted access to your data.

The Lender may use credit reference and fraud prevention agencies to help them make decisions. A condensed guide to the use of your personal information by the Lender and at Credit Reference and Fraud Prevention Agencies

If you apply for a mortgage product through HOOCHT., we will provide the information we hold about you to the Lender. The Lender will use this information to help make its decision about whether or not to lend to you. This will involve checking the following records about you and others:

  • its own;
  • those at credit reference agencies (CRAs); and
  • those at fraud prevention agencies (FPAs).

When CRAs receive a search from the Lender they will place a search footprint on your credit file that may be seen by other Lenders. They supply to Lenders both public (including the electoral register) and shared credit and fraud prevention information. Having multiple search footprints on your credit file may affect your ability to borrow in the future.

The Lender will make checks such as assessing your application for credit and verifying identities to prevent and detect crime and money laundering. The Lender may also make periodic searches at CRAs and FPAs to manage your account with them.

If you are making a joint application or tell us or the Lender that you have a spouse or financial associate, the Lender will link your records together, so you must be sure that you have your partner’s agreement to disclose information about them. CRAs also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link.

Information on applications will be sent to CRAs and will be recorded by them. Where you borrow from the Lender, the Lender will give details of your accounts and how you manage it/them to CRAs. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs and FPAs to perform similar checks and to trace your whereabouts and recover debts that you owe. Records remain on file for 6 years after they are closed, whether settled by you or defaulted.

If you give false or inaccurate information and the Lender suspects or identifies fraud, the Lender will record this and may also pass this information to FPAs and other organisations involved in crime and fraud prevention.

If you have borrowed from the Lender and do not make payments that you owe them, the Lender will trace your whereabouts and recover debts.

The Lender and other organisations may access and use from other countries the information recorded by fraud prevention agencies.

Your data may also be used for other purposes for which you give your specific permission or, in very limited circumstances, when required by law or where permitted under the terms of the Data Protection Act 1998.
